Terms of Service

PLEASE READ CAREFULLY. By downloading, installing, or using the Style Passport mobile application, website, or any related services (collectively, the “Service”), you (“you” or “User”) agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the Service.

1. Overview

Style Passport B.V. (“Style Passport,” “we,” “our,” or “us”) provides an AI-powered personal-styling quiz, body & colour analysis, and affiliate shopping recommendations. Style Passport is not a medical, dermatological, or financial advisor; all guidance is for informational and personal-style purposes only.

2. Eligibility

  • Adults only. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
  • No child accounts. Minors may use the Service only through a parent or guardian’s account.
  • Legal capacity. By using the Service you confirm you are legally able to accept these Terms.

3. Account Registration & Security

  • Provide accurate, current information and keep it updated.
  • Safeguard your login credentials; you are responsible for all activity under your account.
  • Notify us immediately at support@stylepassport.app of unauthorised use or security breaches.

4. Subscriptions, Payments & Cancellation

  • Plans. The Service offers a free tier and auto-renewing monthly or yearly “Style Passport Premium” subscriptions.
  • Billing. Payments are processed by the Apple App Store or Google Play; we never store full payment-card details.
  • Auto-renewal. Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends.
  • Cancellation & refunds. Manage or cancel in your App-Store subscription settings. Refunds follow marketplace policies; Style Passport cannot issue direct refunds.
  • Price changes. We may change prices with at least 30 days’ notice via email or in-app alert. Cancel before the effective date if you disagree.

5. Licence & Intellectual Property

  • Licence to you. We grant you a limited, non-exclusive, revocable, non-transferable licence to use the Service for personal, non-commercial purposes.
  • Our IP. All software, content, trademarks, and data (except User Content) belong to Style Passport or its licensors.
  • User Content. You own the text, photos, and data you upload. By submitting User Content you grant Style Passport a worldwide, royalty-free licence to host, reproduce, modify, and use it solely to operate and improve the Service.
  • Feedback. Any suggestions you submit may be used by Style Passport without restriction or compensation.

6. Acceptable Use

You must not:

  1. Violate any law, regulation, or third-party right.
  2. Upload content that is defamatory, hateful, pornographic, exploitative, or infringes intellectual-property rights.
  3. Reverse-engineer, decompile, or attempt to extract source code or AI models.
  4. Use the Service to build or train competing AI systems.
  5. Interfere with servers, networks, or security features.
  6. Send automated queries, bulk messages, or spam.

We may suspend or terminate accounts that breach these Terms or our Community Guidelines.

7. Style & AI Disclaimers

  • Informational only. All advice is general fashion guidance, not medical, dermatological, or legal advice.
  • No professional relationship. Using the Service does not create a stylist-client, doctor-patient, or other fiduciary relationship.
  • AI limitations. Recommendations are generated probabilistically and may be incomplete or inaccurate. Verify sizing, fabric content, and suitability before purchase.
  • Affiliate disclosure. We earn commission from some merchant links, but pricing is unaffected.

8. Privacy

Our collection and use of personal data are governed by the Style Passport Privacy Policy, which is incorporated by reference. Review it at stylepassport.app/privacy.

9. Termination

  • By you. Delete your account anytime in App > Settings > Delete Account; subscriptions remain active until the period ends.
  • By us. We may suspend or terminate the Service or your access immediately for breach of these Terms, suspected fraud, or platform security risks.
  • Survival. Provisions on intellectual property, disclaimers, limitation of liability, dispute resolution, and any others intended to survive will do so after termination.

10. Third-Party Services & Links

The Service links to third-party retailer sites and uses SDKs (analytics, crash reporting). We are not responsible for third-party content or practices; your use is at your own risk and subject to those providers’ terms.

11. Warranty Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” STYLE PASSPORT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE OR COMPLETE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • STYLE PASSPORT AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.
  • OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED EUR 100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain disclaimers; these limits may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Style Passport, its directors, employees, and partners from any claims, damages, or expenses (including attorneys’ fees) arising from: (a) your use of the Service; (b) your User Content; or (c) your breach of these Terms or any law.

14. Dispute Resolution & Arbitration (U.S. users)

  • Informal resolution. Email legal@stylepassport.app first; we’ll try to resolve within 30 days.
  • Binding arbitration. If unresolved, disputes will be settled by confidential, individual arbitration under AAA Consumer Arbitration Rules.
  • Class-action waiver. Disputes must be brought individually; class actions are not allowed.
  • Opt-out. You may opt out of arbitration by emailing legal@stylepassport.app within 30 days of first accepting these Terms.
    EU/UK consumers may bring disputes before their local courts or designated ADR bodies.

15. Governing Law

  • United States & other regions: Delaware, USA law (excluding conflict-of-law principles).
  • EEA, UK & Switzerland: Mandatory consumer protections of your residence country apply; local courts have jurisdiction.

16. Changes to These Terms

We may update these Terms for new features, legal requirements, or business changes. Material changes will be announced at least 7 days before effect via email or in-app notice. Continued use after the effective date constitutes acceptance.

17. Miscellaneous

  • No waiver. Failure to enforce any provision is not a waiver.
  • Severability. If any provision is unenforceable, the remainder remains in effect.
  • Force majeure. We’re not liable for delays caused by events beyond our reasonable control.
  • Entire agreement. These Terms and the Privacy Policy are the complete agreement between you and Style Passport regarding the Service, superseding prior agreements.
